Terms of Service

1. Introduction

This Terms of Service Agreement (“Agreement”) governs your use of the Get It KoCo website and services (“Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.

If you do not agree, you must not use the Services. Get It KoCo may update or amend these Terms at any time by posting a revised version on the website. Continued use of the Services constitutes acceptance of the updated Terms.

2. Service Overview

Get It KoCo operates as an Australia-based purchasing agent. We do not manufacture, own, or directly sell products.

We purchase products from third-party sellers in South Korea and Australia on your behalf, based on the links, options, and quantities you provide.

By using our Services, you acknowledge that Get It KoCo acts solely as an agent and not as the original seller, brand, or manufacturer.

2-A. Eligibility

Our Services are intended for individuals aged 18 or older.

By using our Services, you represent and warrant that you are at least 18 years old.

Get It KoCo does not knowingly provide Services to minors under the age of 18.

If it is discovered that a minor has placed an order or provided personal data, Get It KoCo reserves the right to cancel the order, delete related data, and terminate the account without liability.

3. Orders and Payments

All requests must include accurate product links, options, and quantities.

Once an order is confirmed and payment has been received, it cannot be modified or canceled, except as required by law.

Prices are quoted in Australian Dollars (AUD) or U.S. Dollars (USD) as specified at checkout. Currency conversion may be based on Get It KoCo’s internal operating rate, which may differ from publicly available rates.

A service or handling fee may apply to cover inspection, secure packaging, and consolidation, and will be disclosed prior to payment.

Shipping fees are calculated separately and must be paid in full before dispatch.

Get It KoCo may, at its discretion, split or consolidate shipments.

Get It KoCo reserves the right to reject or cancel orders that:

Contain prohibited or restricted items.

Violate compliance or risk management policies.

Fraudulent or suspicious transactions may result in cancellation, service refusal, or account suspension.

4. Delivery and Risk of Loss

Shipments are arranged via EMS or other reliable international couriers.

Estimated delivery times are provided for reference only and are not guaranteed. Delays may occur due to customs, courier issues, or regulations.

Risk of loss and title pass to the customer once the goods are delivered to the carrier in South Korea or Australia.

Tracking numbers will be provided by email after shipment.

5. Returns and Refunds

Due to the nature of purchasing agent services, returns and refunds are strictly limited.

Returns and refunds are permitted only if:

The product is defective or incorrect, or

A cancellation request is made before the product has been purchased in South Korea or Australia.

No refunds are available for:

Change of mind after purchase, or

Items that cannot legally be returned or resold in the origin country.

Refunds, when approved, will be issued via the original payment method within 14 business days.

Shipping charges, handling fees, and customs duties are non-refundable once the purchase has been executed.

Any customs duties, VAT, or local taxes paid are strictly non-refundable under any circumstances.

Customers are responsible for return shipping costs and any related fees.

6. Customer Responsibilities

You are the importer of record and are solely responsible for compliance with all laws and regulations of the destination country.

You are responsible for payment of customs duties, VAT, import taxes, and clearance fees.

You are responsible for providing accurate shipping information. Get It KoCo shall not be liable for losses resulting from errors in information you provide.

By using our Services, you also agree to be bound by the terms, conditions, and policies of the original seller or marketplace from which products are purchased.

7. Representations and Warranties (Customer)

By using the Services, you represent and warrant that:

All information you provide is true, accurate, and complete.

You will not use the Services for unlawful, fraudulent, or prohibited purposes.

You will comply with all applicable import, export, tax, and customs laws.

8. Limitation of Liability

Get It KoCo shall not be liable for:

Customs delays, duties, taxes, or import restrictions.

Loss, delay, or damage caused by third-party couriers.

Product defects, damages, or warranty issues attributable to the original seller or manufacturer.

Incorrect or incomplete information provided by the customer.

All products are purchased from third-party sellers, and all warranties, quality, safety, and compliance remain the responsibility of the original seller or manufacturer.

Limitation of Warranties: ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Liability Cap: To the maximum extent permitted by law, Get It KoCo’s total liability for any claim shall not exceed the total amount paid by you for the relevant order.

9. Prohibited and Restricted Items

Get It KoCo strictly prohibits the purchase, handling, or shipment of any items restricted under:

International shipping and transport regulations (IATA, ICAO, IMO).

South Korean and Australian export control and customs laws.

Destination country import laws, courier restrictions, or sanctions regulations.

Prohibited and restricted categories include, but are not limited to:

Hazardous or dangerous goods (chemicals, paints, compressed gases, lithium batteries, power banks, aerosols, perfumes, flammable or explosive items).

Perishable, frozen, or temperature-sensitive goods (including fresh food, dairy, meat, and seafood).

Alcoholic beverages, tobacco, and vaping products (including e-liquids and cartridges).

Medical, pharmaceutical, and healthcare products (prescription drugs, needles, syringes, injectable substances, medical devices restricted by law).

Weapons, ammunition, explosives, fireworks, or related components.

Art, antiques, precious metals, gemstones, or high-value collectible goods.

Cash, coins, negotiable instruments, credit/debit cards, SIM cards, securities, passports, and other government-issued documents.

Plants, seeds, soil, live animals, and agricultural products.

Any counterfeit, imitation, or trademark-infringing goods, or items that violate intellectual property rights.

⚠️ Responsibility Disclaimer: Any fines, penalties, storage charges, seizures, or losses arising from the customer’s request for prohibited or restricted items are the sole responsibility of the customer. Get It KoCo reserves the right, at its sole discretion, to refuse, suspend, or cancel any such orders, even after payment, and without liability for refunds or damages.

10. Privacy and Data Protection

Your use of the Services is subject to our Privacy Policy, which governs how we collect, use, and safeguard personal information.

By using the Services, you consent to the processing of your personal data in accordance with the Privacy Policy.

Get It KoCo may retain personal data for as long as necessary to fulfill the purposes set forth in the Privacy Policy or as required by law.

Get It KoCo designates its internal Data Protection Officer (DPO) as the responsible person for privacy matters, reachable at getitkoco@gmail.com.

11. Fraud Prevention and Payment Disputes

Get It KoCo may require additional verification (e.g., identification documents, proof of address, payment confirmation) for suspicious or high-value transactions.

If a chargeback or payment dispute is initiated, Get It KoCo reserves the right to suspend the account and recover all associated costs, including bank fees and administrative expenses.

Fraudulent or abusive disputes may result in permanent account termination.

12. Third-Party Services Disclaimer

Our Services rely on third-party providers such as payment gateways, shipping companies, and IT platforms.

Get It KoCo does not control these third parties and shall not be liable for their acts, omissions, delays, or failures.

13. Export Control and Sanctions Compliance

You agree not to use the Services to export, re-export, or transfer products in violation of applicable export control or sanctions laws, including but not limited to the laws of Australia, South Korea, the United States, and international regulations.

14. Intellectual Property Rights

All website content, including text, graphics, logos, icons, software, and designs, is the property of Get It KoCo or its licensors and is protected under applicable copyright and intellectual property laws. You may not reproduce, distribute, or exploit any content without prior written permission.

15. Indemnification

You agree to indemnify, defend, and hold harmless Get It KoCo, its affiliates, and employees from any claims, losses, damages, liabilities, or expenses (including legal fees) arising out of your:

Violation of these Terms,

Breach of applicable laws or regulations, or

Misuse of the Services.

16. Termination of Service

Get It KoCo reserves the right, at its sole discretion, to suspend or terminate your access to the Services, with or without notice, if:

You violate these Terms,

You engage in fraudulent or abusive activity, or

Such action is necessary for compliance or risk management.

17. Force Majeure

Get It KoCo shall not be held liable for delays or failure to perform caused by events beyond reasonable control, including natural disasters, labor strikes, war, terrorism, pandemics, government regulations, supply chain disruptions, or failures of telecommunications or internet services.

18. Compliance with AML & CTF

Get It KoCo complies with applicable Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) regulations. We reserve the right to refuse, suspend, or cancel transactions suspected of involving money laundering, terrorist financing, or other unlawful activity.

19. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of Australia, excluding its conflict of laws principles.

Mandatory consumer protection laws in the customer’s jurisdiction may still apply.

All disputes shall be subject to the exclusive jurisdiction of the competent courts in Australia.

At Get It KoCo’s discretion, disputes with international customers may alternatively be referred to binding arbitration under the rules of the Australian Centre for International Commercial Arbitration (ACICA), conducted in English.

Dispute resolution shall follow a multi-tier process:

Good-faith negotiation between the parties;

If unresolved, binding arbitration;

If arbitration is not applicable, resolution in the competent courts of Australia.

All claims must be filed individually. Class actions, representative proceedings, or consolidated claims are expressly waived.

20. Storage, Abandonment, and Unclaimed Packages

If a package is refused, unclaimed, or delayed due to unpaid duties, incomplete documents, or other reasons attributable to the customer, it may be returned, abandoned, or destroyed by customs or courier authorities. Get It KoCo bears no responsibility for such outcomes.

Re-shipment may be possible only at the customer’s request and expense, including all storage, return, and additional shipping fees.

21. Insurance

Customers may request shipping insurance at their own expense.

If no insurance is purchased, Get It KoCo assumes no liability for loss, theft, or damage occurring after transfer to the courier.

22. Claim Time Limit

Any shipping-related claims (loss, damage, or missing items) must be reported to Get It KoCo within 7 calendar days of delivery confirmation. Claims submitted after this period will not be accepted.

23. Service Suspension and Maintenance

Get It KoCo may, at its discretion, temporarily suspend or restrict access to the Services for maintenance, security updates, system failures, or other operational reasons. Such suspension shall not constitute a breach of contract, and Get It KoCo shall not be liable for any damages arising from such interruptions.

24. Severability, Waiver, and Survival

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in effect.

Courts may, if permitted by law, modify unenforceable provisions to the minimum extent necessary (“blue pencil rule”).

Failure to enforce any provision shall not constitute a waiver of future enforcement.

The following provisions survive termination: Limitation of Liability, Indemnification, Intellectual Property, Governing Law, Dispute Resolution, Export Compliance, AML/CTF Compliance, Storage & Abandonment, Insurance, and Claim Time Limit.

25. Time Limitation for Claims

Any claim or cause of action arising from the use of the Services must be filed within one (1) year from the date the claim arises. Otherwise, it shall be permanently barred.

26. Assignment

Get It KoCo may assign or transfer its rights and obligations under this Agreement, in whole or in part, to any affiliate or successor entity without prior customer consent.

27. Governing Currency

All payments, refunds, and financial transactions are generally processed in Australian Dollars (AUD) or U.S. Dollars (USD) depending on the transaction platform.

Exchange rate differences, bank charges, or international transaction fees are the sole responsibility of the customer.

28. Language of Agreement

These Terms may be translated into other languages for convenience. In the event of any inconsistency, the English version published by Get It KoCo shall prevail and be legally binding.

29. Notices

Legal or contractual notices may be provided by Get It KoCo through email, website postings, or other reasonable electronic means.

Such notices shall be deemed delivered and effective when sent or published, regardless of whether accessed by the customer.

30. Electronic Communications

You consent to receive communications from Get It KoCo electronically, including emails, website notices, or SMS.

You agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirements for written communication.

31. Entire Agreement

This Agreement constitutes the entire agreement between Get It KoCo and the customer regarding the Services and supersedes any prior written or oral agreements.

32. Amendments

Get It KoCo may amend these Terms at any time by posting an updated version on the website.

Continued use of the Services constitutes acceptance of such amendments.
